Agreement to Terms
These Terms of Use ("Terms") are a legal agreement between you and Arrowkite LLC ("Arrowkite," "we," "our," or "us"), governing your use of the Napsy mobile application, Alexa skill, and website at napsyapp.com (collectively, the "Service").
By downloading, installing, or using Napsy, you agree to be bound by these Terms. If you do not agree, do not use the Service.
Description of Service
Napsy is a baby nap tracking application that allows parents and caregivers to record nap times, view nap history, and receive age-based wake window suggestions. The Service includes a mobile application for iOS, an Amazon Alexa skill, and a supporting website.
Napsy is designed as a convenience tool for parents and caregivers. It is not a medical device and does not provide medical advice. See the "Disclaimer" section below for more details.
Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account and use Napsy. The Service is intended for use by parents, guardians, and caregivers of infants and young children. By using the Service, you represent that you meet these eligibility requirements.
Account Registration
To use certain features of Napsy, you must create an account using email/password, Google Sign-In, or Apple Sign In. You agree to:
- Provide accurate and complete registration information
- Keep your login credentials secure and confidential
- Notify us promptly if you suspect unauthorized access to your account
- Accept responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.
Acceptable Use
You agree to use the Service only for its intended purpose โ tracking naps and sleep patterns for infants and young children in your care. You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse engineer, decompile, or disassemble the application
- Interfere with or disrupt the Service, its servers, or connected networks
- Attempt to gain unauthorized access to other users' accounts or data
- Use automated systems (bots, scrapers) to access the Service
- Transmit viruses, malware, or any harmful code through the Service
- Use the Service to collect or harvest personal data about other users
Alexa Skill
If you choose to link Napsy to your Amazon Alexa device, you acknowledge that:
- The Alexa skill is governed by these Terms as well as Amazon's Alexa Terms of Use
- Voice commands are processed by Amazon and are subject to Amazon's privacy practices
- You can unlink Napsy from Alexa at any time through the app settings or the Amazon Alexa app
- Napsy's Alexa functionality depends on Amazon's services and may be affected by outages, changes, or discontinuations outside our control
Intellectual Property
The Service and its original content, features, functionality, design, and branding (including but not limited to the Napsy name, logo, custom icons, and visual design) are owned by Arrowkite LLC and are protected by copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, distribute, sell, or create derivative works based on the Service.
User Data
You retain ownership of the nap data and personal information you provide to the Service. By using Napsy, you grant us a limited license to store, process, and display your data solely for the purpose of providing and improving the Service.
Our collection, use, and protection of your data is described in our Privacy Policy, which is incorporated into these Terms by reference.
Disclaimer
Napsy is not a medical device. The wake window suggestions, nap length recommendations, and other guidance provided by the Service are based on general developmental guidelines and are intended for informational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment.
Always consult your pediatrician or a qualified healthcare provider with any questions about your child's sleep, health, or development. Never disregard professional medical advice or delay seeking it because of information provided by Napsy.
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.
Limitation of Liability
To the maximum extent permitted by applicable law, Arrowkite LLC and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, goodwill, or other intangible losses, arising out of or related to:
- Your use of or inability to use the Service
- Any reliance on wake window suggestions, nap recommendations, or other information provided by the Service
- Unauthorized access to or alteration of your data
- Interruptions, delays, or errors in the Service
- Any third-party services (including Amazon Alexa, Google, or Apple) connected to the Service
In no event shall our total liability to you exceed the amount you have paid to us for the Service in the twelve (12) months preceding the event giving rise to the claim, or fifty dollars ($50), whichever is greater.
Indemnification
You agree to indemnify, defend, and hold harmless Arrowkite LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any rights of another party.
Third-Party Services
Napsy integrates with or relies on third-party services including Supabase (data storage), Amazon Alexa, Google Sign-In, Apple Sign In, and Expo (push notifications). We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of these services is subject to their respective terms and privacy policies.
Service Availability & Modifications
We strive to keep Napsy available and functioning, but we do not guarantee uninterrupted access. We reserve the right to:
- Modify, update, or discontinue any part of the Service at any time, with or without notice
- Perform maintenance that may temporarily limit availability
- Add or remove features at our discretion
We will make reasonable efforts to notify you of significant changes that materially affect your use of the Service.
Pricing & Future Paid Features
Napsy's core nap tracking features are currently free to use. We may introduce optional paid features or subscriptions in the future. If we do, we will clearly communicate pricing before you are charged, and your continued access to free features will not be contingent on purchasing paid features. No charges will be applied without your explicit consent.
Termination
You may stop using the Service at any time by deleting the app and requesting account deletion by contacting us at support@napsyapp.com.
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, if we believe you have violated these Terms or if continued access would pose a risk to us, our users, or the Service.
Upon termination, your right to use the Service ceases immediately. We will delete your account data within 30 days of an account deletion request, except where we are legally required to retain it.
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, United States, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith informal negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue resolution through the courts located in the State of Georgia.
You agree that any claim or cause of action related to the Service must be filed within one (1) year after the claim arose, or it will be permanently barred.
Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Arrowkite LLC regarding your use of the Service. They supersede any prior agreements, understandings, or representations relating to the same subject matter.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before the changes take effect. The "Last Updated" date at the top of this page reflects the most recent revision.
Continued use of the Service after changes become effective constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the Service.
